We work for both parties in order to find an acceptable solution that they can agree to and therefore settle the dispute. 25% of our fee is only paid to us when the dispute is resolved to the acceptance of all concerned. This is our incentive to work towards a resolution.
We investigate the merits of the case with both parties in order to understand and resolve the issue. We work to ensure that any confidential or sensitive data is not disclosed to the other party without obtaining the proper consent from the relevant entity concerned. Both parties agree, up front and in writing, that any information that they have provided to us, cannot be subpoenaed or otherwise demanded from us in any legal proceedings. Both clients also have to agree that we cannot be involved as a witness, or otherwise, in any litigation process.
Our fees are paid in equal shares by both parties. Either client can withdraw from this process at any time and for any reason. We only work on cases where both clients are willing to cooperate and are comitted to working diligently with us to find a resolution.
We charge on an hourly basis and we work off a prepaid retainer that is to be paid equally by both clients. Our work-in-process rate is a combined $150 per hour (75% of $200) plus expenses, such as board and fare. All air travel in North America is via first class, while overseas travel is via business class. Once the dispute has been resolved and accepted by both clients, we will bill the additional 25% ($50) for all hours worked since the commencement of the project. This additional fee will be split equally between the parties. Therefore at the conclusion of a dispute resolution engagement, the effective rate paid by each participant will range from $75 to $100 per hour, depending on the outcome of the engagement.
